This item was deferred on November 9, 1981 until May, 1982;
however, it was updated and rescheduled for today.

i. Request for a variance by Bible Baptist Church to Section 4.4(b)
of the Subdivision Ordinance which requires lot dirnensions to
conform to the Comprehensive Zoning Ordinance. The applicant
wishes to subdivide a 4.4-acre tract out of an existing farm t
site in order to permit construction of a church. The site
is located along the south side of Salem Road, west of Highland
Drive (Kempsville Borough).

The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday, 11 January
1982, at Twelve o'clock noon.
Council Members Present:
John A. Baum, E. T. Buchanan, F. Reid Ervin, Vice Mayor
Harold Heischober, Barbara M. Henley, Clarence A. Holland,
M.D., Reba S. McClanan, Mayor J. Henry McCoy, Jr., D.D.S.,

ITEM #17602
Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration of employment,
assignment, appointment, promotion, performance, demotion,
salaries, disciplining or resignation of public officers,
appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration of the
condition, acquisition or use of real property for public
purpose, or of the disposition of publicly held property,
or of plans for the future of an institution which could affect
the value of propert owned or desirable for ownership by
such institution.***
3. LEGAL MATTERS: Consultation with legal Counsel and briefings
by staff members, consultants or attorneys, pertaining to
actual or potential litigation, or other legal matters
within the jurisdiction of the public body.
***This matter was placed on Executive Session at the request of the
City Attorney

JOINT MEETING ITEM #17603
Mayor McCoy advised that the purpose of the meeting beginning at
12:00 Noon was to invite Dr. E. E. Brickell, Superintendent of
Schools, and Dr. Fred Benham, Director of the Budget and Clerk
of the Board, to discuss Impact Funds and other matters concerning
school financing.
Councilwoman Henley advised she may have been misunderstood when
requesting this meeting, in that she had meant meeting with the
School Board Members and not the School Superintendent. The
letter from Dr. Brickell (4 January 1982), suggested meeting with
the School Board.
Dr. Brickell advised his letter contained what Councilwoman Henley
had stated, and Vice Chairman Robert H. Callis, Jr., was appearing
in behalf of the School Board, as Dr. Woods was out of the City
due to a death in the family. Dr. Brickell advised, however, that
the point was very well taken and since the letter was received by City
Council, the situation has worsened.
On 28 December 1981 a check (Impact Funds), was received by the
School Board and, because of the amount of money, Dr. Benham
telephoned Mr. Donald McGill and discussed the matter with him.
The Impact Aid Office reduced Virginia Beach's entitlement by
$2-Million of the $7-Million proposed.
In December the Office of Management and Budgeting "leaked" the
fact that it was attempting to eliminate Impact Aid entirely.
At this point, the School Board has received $1.3-Million, which
could possibly be all they would receive this fiscal year if the
President of the United States and the Office of Management and
Budgeting are successful in their efforts to eliminate Impact
Aid.
The School Board is "on a Continuing Resolution and only four (4)
passed since the budget." The Continuing Resolution has the full
force and effect of the Law.
Dr. Brickell further advised that historically, Virginia Beach has
been blessed with Impact Aid for numerous years, and the Attorney
General has advised the State will continue to pay Basic Aid through
the current fiscal year; however, Block Grant Funds - Title I - will
be reduced by approximately twenty (20%) percent.
The City Council will hold a Joint Meeting with the School Board
on Monday, 1 February 1982 , at 11:00 a.m., in the Council
Chambers.

TEN PERCENT FOOD TAX ITEM #17604
Mayor McCoy made reference to a letter received from Robert Herman,
The Lighthouse Restaurant, requesting Council "broaden the base of
food tax and reduce it fairly".
APPEARANCE BEFORE COUNCIL ITEM #17605
Mayor McCoy advised that Robert Engasser has requested to appear
before Council to discuss matters of public safety in Virginia
Beach.
It was the consensus of Council to permit Mr. Engesser to speak
before Council on 1 February 1982 for ten (10) minutes.
LAKE SHORES/SHENSTONE GREEN ITEM #17606
Mayor McCoy advised Council of a letter received from J. E. Laughlin,
5252 Shenstone Circle, requesting certain information be made available
for review with regard to the installation of sewer in the subdivisions
of Lake Shores and Shenstone Green.

ORDINANCES/DEAD ANIMALS ITEM #17607
Councilwoman McClanan advised that the Ordinance on today's Agenda
(1/11/82) relating to the disposition of dead animals is a much
more comprehensive Ordinance than the disposition of JUST dead
animals; and, advised further only the Ordinance pertaining to
the disposition of dead animals should be voted on at this time.

RESOLUTION VOTING PRECINCTS ITEM #17608
Councilman Buchanan advised that on the Resolution concerning
Voting Precincts he was under the impression that Oceana was
to be "looked at" in addition to Seatack.
The City Manager advised that the voters in Oceana vote in the
Seatack precinct.
Councilman Holland advised he was under the impression that some
residents in the Shelton Park area voted at the Chesapeake Beach
precinct.
The City Manager advised the residents of Lake Shores now voting
in Chesapeake Beach will be voting at Shelton Park.
ORDINANCE/POSTAL SERVICE ITEM #17609
Councilwoman Oberndorf made reference to a letter received from
Miss Grace Moran requesting an Ordinance be drafted to eliminate
the problem of the U. S. Postal Service in delivering mail to
receptacles whose access is obstructed.
City Council directed the City Attorney to study the legal aspects and
draft an Ordinance regarding the obstruction of mailboxes.
LETTER ADVISING OF SEWER ITEM #17610
Councilwoman Oberndorf advised that at last week's meeting (1/4/82),
during the discussion of sewer installation in the Avalon Terrace
area, several suggestions were made. One suggestion was to forward
a letter to the residents one (1) year prior to sewer installation.
The City Manager advised advance notice is being given but he would
review the time schedule.
REPORT ON VARIANCES ITEM #17611
Councilman Baurn had previously requested a report on variances in the
rural area of Virginia Beach and asked that this report be presented
soon.
The City Manager advised that Robert Scott and a member of his staff
have been working on this report and it should be ready in the near
future.

PARKING METERS ITEM #17612
The City Manager advised he has studied the matter of parking meters
and he and his staff feel the meters should remain at a two-hour
limit, using the existing two-hour time frame now being utilized.
The average turn-over on all meters is one hour and eighteen minutes.
The Meter Maid is "turning over vehicles" approximately 5.9 and the
non-metered spaces are "turning over" approximately 2.3.
To change the meters the cost would be approximately $7.00 per meter.
There are 630 meters and it takes approximately 45 minutes to change
each meter.
PRINCESS ANNE ROAD PROJECT ITEM #17613
The City Manager advised that C. Oral Lambert, Director of Public
Works, and David M. Grochmal, Assistant to the City Manager for
Intergovernmental Relations, met with Leo Busser, Deputy Highway
Commissioner, concerning Princess Anne Road.
Mr. Busser was very helpful in assisting ways to expedite Princess
Anne Road and offered to write to local newspapers regarding a
Notice of Willingness to Holding a Public Hearing.
The Plans for Princess Anne Road could be presented to the City
of Virginia Beach in April of 1982, after which the City can
acquire the rights-of-way.
It was noted a Public Hearing was held concerning the alignment of
Princess Anne Road but due to Federal Law a second Public Hearing
should be held.

City Council voted to APPROVE the Minutes of the Regular Meeting of 4
January 1982, as corrected:
ITEM #17586 - Councilwoman Henley made reference to a
letter received from Rebert W. Daniels
Jr., Congressman, Dr. E . E - Brickell,
Superintendent of Schools, concerning
impact aid to our school districts.
Councilwoman Henley requested Council meet
with the School Board to determine the best
possible use-of-these-funds future of impact
funds in the City.
The City budgeted $7-Million, and the Federal
Government advised we would be receiving
$5.2-Million.
A Joint Meeting between the City Council and
the School Board will be held on Monday 11
January 1982.

WHEREAS, on May 18, 1981, the Virginia Beach City
Council adopted a plan establishing new election districts within
the City of Virginia to relieve overcrowding and long lines
during elections; and,
WHEREAS, the creation of these new districts and the
redrawing of old districts necessitated that many voters be switched
to new voting places; and,
WHEREAS, it is City Council 's desire that wherever
possible, voters be allowed to vote at the voting place closest
to their home, and that access for the handicapped to all voting
places be provided.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Virginia Beach, that the Virginia Beach Electoral Board is
hereby requested to re-evaluate the voting district changes previously
made giving special attention to the following precincts: Ocean Park,
Chesapeake Beach, Fairfield, Brandon, Seatack and Lake Christopher.
It is understood that no changes will be made until after state-wide
redistricting is completed by the General Assembly.
BE IT FURTHER RESOLVED that the City Clerk is directed
to forward a copy of this Resolution to the Chairman of the Electoral
Board of the City of Virginia Beach.

AN ORDINANCE TO AMEND AND REORDAIN
ARTICLE 11 OF THE COMPREHENSIVE
ZONING ORDINANCE OF THE CITY OF
VIRGINIA BEACH, VIRGINIA, PERTAINING
TO THE PLANNED UNIT DEVELOPMENT DISTRICTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That Article 11 of the Comprehensive zoning ordinance
of the City of Virginia Beach is hereby amended and reordained as
follows:
Section 1100. General legislative intent.
The intent of this Article is to encourage a more
efficient use of land and of public services by allowing under
certain circumstances a more flexible means of land development
than is otherwise permissible under lot-by-lot restrictions. In
view of the substantial public advantages of planned unit
development, it is the intent of this Article to promote and
encourage development in this form where appropriate in location
and character. It is the intent to recognize those areas
currently developed, being developed, or proposed for development
under Planned Unit Development Regulations as zoned PD-H1. It is
not the intent to create additional PD-H1 Districts, or to
enlarge the limits of existing PD-H1 Districts. It is the intent
to encourage additional planned unit developments through
regulation by the PD-H2 District in order to encourage planned
unit developments as a means of creating an improved living
environment through unified planning, land design, and building
operations, to encourage variety in housing needed to meet
changing housing demands and to provide adequate community
facilities, to protect the natural beauty of the landscape, to
encourage preservation and more efficient use of open space, to
offer an opportunity for design flexibility and encourage
innovations to allow for lower long term municipal maintenance

costs, and to take full advantage of passive solar energy
resources.
A. PD-H1 PLANNED UNIT DEVELOPMENT DISTRICT
Section 1110. Land use regulation.
(a) The land use plan approved by city council, or as
modified, for each planned unit development project shall govern
the development, and all land uses shall be in accordance with
it.
(b) Modifications to the land use plan by city council
shall be in the manner of a zoning change.
(c) Within a PD-H1 District, all of the principal uses
and structures permitted within an A-1 Apartment District other
than hospitals and sanitariums, together with the following
enumerated uses and structures, shall be permitted:
(1) Fraternity and sorority houses, student
dormitories and student centers;
(2) Homes for the aged, disabled or handicapped,
including convalescent or nursing homes and
maternity homes;
(3) Marinas:
(4) Private clubs or social centers provided that
clubs where conduct of commercial affairs is
a principal activity shall not be permitted.
(d) Other uses may be permitted if specifically
approved as part of the plan, provided that the areas and
structures occupied shall be so located and designed as to
protect the character of the district and the character of the
surrounding property and shall not in combination occupy more
than five (5) percent of the land area of the district, and
provided further that convenience establishments and shopping
centers shall be subject to additional requirements as herein
specified:

Commercial areas of less than three (3)
acres.
(i) Such establishments and their parking
areas shall not occupy more than two and
one-half (2.5) percent of the land area
of the development.
(ii) Such establishments shall be limited to
trade and service facilities such as
stores, eating and drinking
establishments (except drive-in), coin
operated laundry and dry cleaning
establishments and laundry and dry
cleaning agencies, beauty shops and
barber shops. However, service stations
and repair garages shall not be
permitted as convenience establishments.
(iii) Such establishments shall be so located,
designed and operated as to serve
primarily the needs of persons within
the district and not persons residing
elsewhere.
(iv) Off-street parking and loading
requirements shall be determined by the
Planning Director as appropriate to the
particular case based upon the types of
convenience establishments permitted and
the anticipated proportion of walk-in
trade. Multiple use of off-street
parking and service areas and accessways
for convenience establishments may be
permitted, if such multiple use will not
lead to congestion or the creation of

hazards to pedestrian or vehicular
traffic.
(v) No building permit for any convenience
establishment shall be issued nor inay
any building be used for a convenience
establishment before building permits
for at least one hundred (100) dwelling
units within a radius of 1,000 feet of
the proposed estabishment have been
issued.
(2) Commercial areas of three (3) acres or more.
(i) Such centers shall be included as an
integral part of the PD-H1 District.
(ii) Such centers shall have direct access to
no less than a secondary street and
shall be located and designed without
creating congestion or traffic hazards
on any street.
(iii) Design of parking and service areas,
entrances, exits, yards, courts and
landscaping, shall preserve the
residential character of the PD-H1
District and of any adjoining
residential district.
(iv) Shopping center parking and service
areas and accessways may serve other
non-residential uses in the vicinity, if
such multiple use will not lead to
congestion or the creation of hazards to
pedestrian or vehicular traffic.
(v) No building permit for any shopping
center shall be issued prior to

contruction of at least 250 dwelling
units in the PD-H1 project.
(vi) Offstreet parking requirements shall be
as specified in the B-2 District.
Section 1111. Density requirements.
The maximum density per gross acre shall not exceed
four and one-fourth (4.25) dwelling units per acre.
Section 1112. Housing requirements.
In order to create a diversified, interesting and
attractive complement to the city and provide visual satisfaction
to the general public as well as to offer varying living
opportunities to future residents, the following housing
restrictions shall apply:
(a) Dwellings, single family. A variety of lot sizes
and dwelling types is desirable. Single family dwellings shall
comprise at least forty-five (45) percent of the dwelling units.
(b) Remaining property devoted to housing shall be
divided among at least two (2) other dwelling unit types, among
which may be:
(1) Duplex;
(2) Townhouses;
(3) Multiple family;
(4) Semi-detached.
B. PD-H2 PLANNED UNIT DEVELOPMENT DISTRICT
Section 1120. Application.
Procedures for application for a change of zoning to
PD-H2 District shall be the same as for all other zoning
categories. In addition to information otherwise required by
this ordinance, there shall also be included with the application
a proposed PD-H2 Land Use Plan as well as such additional
supplementary information as necessary to satisfy the conditions

of this article. PD-H2 Districts may be established only in
existing residential or apartment districts subject to the
general requirernents and according to the procedure specified
herein. where the Land Use Plan calls for open space to be owned
or maintained by any private entity, then a petition for change
of zoning to P-1 on such land shall accompany this petition. As
an exception to Section 107(g), there shall be no fee charged for
such a rezoning petition to P-1, and as an exception to Section
302(a), the minimum lot size requirement of five (5) acres in the
P-1 District shall not apply as it pertains to the rezoning of
this land.
Section 1121. Minimum tract size.
The minimum tract size for PD-H2 development shall be
five (5) acres.
Section 1122. PD-H2 land use plan.
The land use plan shall include the following:
(a) Location of proposed streets;
(b) Proposed number of dwelling units;
(c) Total acreage of the site;
(d) Proposed housing types, location of areas devoted
to each housing type, acreage and number of units
for each such area, and the minimum lot size
proposed for each area and housing type;
(e) Location and nature of other proposed uses;
(f) Location of proposed open spaces and recreational
areas, nature of recreational facilities proposed,
and means of maintenance of such;
(g) Regulations governing the height, setback
requirements, off-street parking requirements and
sign restrictions for each area within the PD-H2
project.

When adopted, the PD-H2 Land Use Plan shall serve as a
supplement to and, where they conflict, as a replacement for, the
zoning regulations of the underlying district.
Section 1123. Allowed uses.
Within the PD-H2 District, only the following uses and
structures shall be permitted:
(a) Principal uses and structures:
(1) Dwelling units of the types specified in the
Land Use Plan;
(2) Public buildings, structures, and other
public uses;
(3) Recreational facilities of the type described
in the plan;
(4) Child care education centers, in connection
with public or private elementary schools or
churches;
(5) Day care centers;
(6) Public utilities installations and
substations; provided offices or storage
or maintenance facilities shall not be
permitted; and provided, further, that
utilities substations, other than individual
transformers, shall be surrounded by a wall,
solid except for entrances and exits, or by a
fence with a screening hedge five (5) to six
(6) feet in height; and provided also,
transformer vaults for underground utilities
and like uses shall require only a landscaped
screening hedge, solid except for access
opening.
(b) Accessory uses.

Uses which are customarily accessory and clearly
incidental and subordinate to the principal use
shall be allowed as accessory use.
(c) Conditional uses.
(1) Churches;
(2) Family care homes, foster homes, and group
homes;
(3) Home occupations.
Section 1124. Housing types and density.
Housing types and density for the various areas within
the PD-H2 project shall be as specified on the Land Use Plan.

(a) Homeowners association.
If a homeowners association is to assume ownership
of the open space, then it shall bear all responsibility for
maintenance of the land and all structures thereon. All
landowners in the PD-H2 District shall be members of the
homeowners association. There shall be restrictive covenants
recorded which prohibit use of the subject land for any purpose
but recreation and open space use. Such covenants shall run with
the land and be in full force and effect for a period of at least
fifty years. These covenants shall become part of the deed to
each lot or parcel within the development. Such covenants shall
be approved by the city attorney and recorded before the first
building permit in the project is issued. A rezoning petition to
P-1 Preservation District shall be filed simultaneously with the
rezoning petition to PD-H2, and shall cover all land to be owned
and maintained by the homeowners association.
(b) Dedication to the city.
The open space may be dedicated to the City, but
only upon the concurrence of the city council. If the dedication
is accepted, the open space shall be maintained by the city, and
shall be made available for use by all the residents of the City
of Virginia Beach.
(c) ownership by other public or private entity.
Ownership of the open space may be by another
public or private entity. In this event, a rezoning petition to
P-1 Preservation District shall be filed simultaneously with the
rezoning petition to PD-H2, and shall cover all land to be owned
and maintained by the subject entity. Such entity shall be
responsible for all maintenance of the open space, and shall make
the use and enjoyment of the open space available to all
residents of the PD-H2 project. Additionally, restrictive
covenants as in (a) above shall be filed prohibiting the use of

the subject land for any purpose but recreation and open space
use.
Use of the open space shall in all cases be limited to
those public or private uses specified for the land at the time
of approval of the PD-H2 Land Use Plan.
Section 1126. Changes to approved plan.
Any changes to housing type, density, allowed uses, or
location of any of the elements, or other aspects of the Land Use
Plan, where the change is not clearly in keeping with the concept
of the Plan as approved by City Council, shall require an
amendment to the PD-H2 Land Use Plan. Such amendment shall be
approved only in the manner of approval of the original Land Use
Plan. Changes which clearly are in keeping with the concept of
the Plan as approved by City Council may be made by the Planning
Director.

runway expansion. It is expected that the Airport Industrial
Park (zoned I-1 and I-2), the Lake Wright Golf Coursed (zoned
R-8) and the Burton Station Community Development Target Area
(zoned generally I-1 and R-8) will be subject to moderate levels of noise.
The golf course and industrial park are compatible uses, and the
industrial zoning in Burton Station will alllow a gradual turnover in time
to industrial use while minimizing inconveniences to residents.

That the Comprehensive Plan dated October 15, 1979, is amended and
reordained by revising the following section entitled "Pungo-Blackwater":
Residential Development
(added by amendment on )
Although this is a highly productive agricultural
area of the City, there is a need for some residential
development in the area, primarily to serve
the needs of those associated with the
agricultural industry, and their families. It is recognized that
large-scale residential development will directly
and indirectly contribute to a change in character
of the area, and will ultimately result in loss of
agricultural land and agricultural productivity.
The zoning ordinance shoudl be used to allow the
type of residential development which is compatible
with the current agricultural character, and to
prohibit that which is contrary to it.

Commercial Development
(added by amendment on )
Commercial development in this study area is not generally
centered in the resort area and along Virginia Beach Boulevard
and Laskin Road. Additional expansion of the commercial
area along Birdneck Road, north of Virginia Beach Boulevard
and along the corridor between and Arts and Conference Center
and the resort area should be encouraged, but expansion to
the West should be considered favorably only if it can be accomplised
in a manner compatible with the existing year-
round residential community in the area. The current extent
of tourist commercial advance varies so much from street to
street that no mapped line can suffice as an appropriate
boundary guide. Instead, each future land use conversion
west of the established tourist area should be weighed on
a case-by-case basis against the factors of a.) extent of
tourist development in the immdiate area, b.) existence
of permanent residences in the immediate area, and c.) com-
patibility with surrounding uses.

That Section 5-14 is amended and reordained hereto as
follows:
Section 5-14. Disposition of dead animals generally.
The owner of any animal which has died from disease or
other cause shall forthwith cremate or bury or dispose of the
remains o.f such animal in a manner authorized by law or cause
such remains to be cremated or buried or disposed of in a manner
authorized by law. If the owner of such animal fails to do so,
the general district court, after notice to such owner, if he can
be ascertained, shall order such dead animal to be cremated or
buried or disposed of in a manner authorized by law by the bureau
of animal control and shall require the owner to pay the city
treasurer the sum of seven dollars ($7.00)
for any hog, sheep, dog, cat or goat and for any other larger
animal the sum of sixty dollars
($60.00), free from all encumbrances in favor of such owner.
This Ordinance shall be effective on and after the date
of its adoption.

(a) A license tax is hereby imposed on dogs required to
be licensed under this article in the following amounts:

(2) For each female dog, unspayed ........... 10.00
(3) For each male dog, neutered ........... 2.00
(4) For each female dog, spayed ........... 2.00
(5) Kennel of five (5) to twenty (20) dogs .. 25.00
(6) Kennel of twenty-one (21) or more ....... 35.00
(b) No license tax shall be levied under this section on
any dog that is trained and serves as a guide dog for a blind
person or that is trained and serves as a hearing dog for a deaf
or hearing-imparied person. For the purposes of this subsection,
a "hearing dog" is a dog trained to alert its owner, by touch, to
sounds of danger and sounds to which the owner should respond.
(c) Any person who applies for a license tag for a
neutered or spayed dog shall present, at the time of application,
certification from a licensed veterinarian attesting to the
neutering or spaying of the dog. If such certification is not so
presented the dog shall be taxed the fee levied on unneutered and
unspayed dogs.
This Ordinance shall be effective on and after the date
of its adoption.

subsection (4) as follows:
Section 5-49. When tax due and payable.
The license tax on dogs shall be due and payable as
follows:
(1) On or before January first and not later than
January thirty-first of each year, the owner of any
dog six (6) months old or older shall pay such
tax.
(2) If a dog shall become six (6) months of age or come
into the possession of any person between January
first and November first of any year, the license
tax for the current calendar year shall be paid
forthwith by the owner.
(3) If a dog shall become six (6) months of age or come
into the possession of any person between October
thirty-first and December thirty-first of any year,
the license tax for the succeeding calendar year
shall be paid forthwith by the owner, and such
license shall protect such dog from the date of
purchase.
(4) Any person transporting a dog into the city from
some other jurisdiciton shall comply with this
section within thirty (30) days from the day he or
she brings such dog into the city, if such dog is
to be kept in the city more than thirty (30) days.

adopt such animal pursuant to such section, he shall pay a fee of
ten dollars ($10.00) to cover
the cost of transfer, seizure and care of the dog or cat. Such
person shall, in the case of a dog, obtain a proper license for
such dog pursuant to article III of this chapter within ten (10)
days of such transfer.
This ordinance shall be effective on and after the date
of its adoption.

That Section 5-11.1 (a), (b), (c) and (d) is added hereto as
follows:
Section 5-11.1. Impoundment-Generally.
(a) It shall be the duty of any animal control officer
of the bureau of animal control who finds any animal subject to
cruel or inhumane treatment in violation of section 5-11, to take
the animal into custody and impound the same at a pound or
enclosure meeting the requirements of section 29-213.19 of the
Code of Virginia. A record shall be made of the time and place
of taking such animal into custody.
(b) If, by a license tag or any other means, the owner
of a animal impounded under this article can be identified, the
superintendent of the bureau of animal control shall, within
forty-eight (48) hours of such impoundment, notify the owner by
telephone or mail of the impoundment of the animal.
(c) Owners having animals impounded under this section
shall be charged a fee of ten dollars ($10.00), plus one dollar
($1.00) for the second day or part thereof that the animal is
impounded and six dollars ($6.00) for each additional day or part
thereof that the animal is impounded. The payment of such fees
shall not relieve the owner from prosecution for violation of
section 5-11.
(d) If a animal impounded under this article is not
claimed by its owner within five (5) days, it shall be disposed
of in accord with the provisions of section 29-213.19 of the Code
of Virginia. In the event a resident of the city proposes to

ten dollars ($10.00) to cover the cost of transfer, seizure and

AN ORDINANCE TO ACCEPT A GRANT
OF $3,115 FROM THE DEPARTMENT
OF TRANSPORTATION SAFETY AND TO
APPROPRIATE THESE FUNDS
WHEREAS, the City of Virginia Beach wishes to provide a higher
level of traffic safety through better management of existing roadways
and to improve the design of future roadways; and,
WHEREAS, the Department of Transportation and Safety has
approved a Grant of $3,115.00 to send two (2) City of Virginia Beach
traffic engineers to a course designed to strengthen their abilities
in these areas.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
THAT the City Manager is hereby authorized to accept this
Grant, and funds are hereby appropriated in the amount of $3,115;
and,
BE IT FURTHER ORDAINED that the appropriation be financed by
$1,558 estimated revenue from the Department of Transportation Safety
and a local match of $1,557 con s i st i ng of $1,165 of an in- ki nd match ,
$200 from the City' s General Fund Bal an ce, and $192 from the City training
committee appropriations.

FISCAL YEAR 1981-82 BUDGET BY
$ 95,771
WHEREAS, City Council approved, in the 1981-82 operating
budget, $523,477 in appropriations and estimated revenues for the
PENDLETON CHILD SERVICE CENTER; and,
WHEREAS, the estimated revenues for fiscal year 1981-82 of
PENDLETON CHILD SERVICE CENTER have been reduced by $95,771; and,
WHEREAS, PENDLETON CHILD SERVICE CENTER is dependent on such
revenue sources:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
THAT the City Manager is hereby authorized to reduce the
PENDLETON CHILD SERVICE CENTER budget by $95,771.
This Ordinance shall be effective from date of adoption.

AN ORDINANCE TO PROVIDE AN ADDITIONAL
CLERK POSITION IN THE SHERIFF'S OFFICE
WHEREAS, the State Compensation Board has approved a
clerk position in the Sheriff's Office due to the increase in
civil process service and related items; and,
WHEREAS, this position is to be solely funded by the
State; and,
WHEREAS, the funding for the remainder of the 1982 fiscal
year is $3,223.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA, that an additional clerk position be
allocated and funds of $3,223 be appropriated to the Sheriff's Office.
This appropriation is to be financed by an increase in
Estimated Revenue from the Commonwealth of $3,223.
This Ordinance shall be effective from date of adoption.
