Merrick. 2. ordinance to amend Section 33-47 of the Code of the City of Virginia Beach, Virginia pertaining to definitions in relation to the tax transients obtaining lodging and hotels, etc. 3. Ordinance, on first reading, to accept a grant in the amount of $13,000 from the bepartment of Corrections, and to appropriate these funds. 4. Ordinance to authorize a temporary encroachment into a portion of the right-of-way of Vanderbilt Avenue to Luke Biernot. 5. Resolution certi,fying the arrangements for the improve- ments of a section of Military Highway (Route 13) to the east corporate limits of the City of Chesapeake for the adjustment and/or relocation of certain utilities and for the installation of any new facilities. 6. Ordinance to authorize the acquisition of property in fee simple for Rudee H4ights PumpingStation, either by agreement or by condeumation. 7. ordinance to authorize the acquisition of property in fee simple for Lotus Garden Bridge replacement, either by agreement or by condemnation. Henry McCoy, Jr., D.D.S., in the Conference Room, City Hall Building, on Monday, 18 May 1981, at Twelve-Thirty in the afternoon. Council Members Present: Jobn A. Baum, F. Reid Ervin, Barbara M. Standing* ITEM #16670 Mayor McCoy entertained a motion to permit Council to conduct its INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the purpose of discussing the,follow.ing: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, salaries, discipline or resigaation of public officers, appointees or employees of any public body. (Persomel Matters). 2. Investing of public ftmds where competition or bargaining are involved where, if made public initially, the financial interest of the governing unit would be adversely affected. It was tbe consensus of Council to meet with the Commission during an INFORMAL BRIEFING SESSION. PRINTER/REVENUES ITEM #16672 Mayor McCoy made reference to a letter received from a Printer concerning taxes he is required to pay the City. M A T T E R S B Y C 0 U N C I L M E M B E R S CORPS OF ENGINEERS ITEM #16673 Councilman Kitchin made reference to a letter received from the Corps of Engineers regarding dredging operations in the Cape Henry Channel. The dredge material will be deposited within the ocean disposal area opposite Dam Neck, and will involve the removal of 600,000 cubic yards of fine sand. MINUTES ITEM #16674 Councilwoman Henley advised Council of a correction needed in the Minutes of 11 May 1981, ITEM #16652, which should state as follows: Councilman Standing made a motion, seconded by Councilman Merrick, that there will be no filling of NEW POSITIONS WITHOTJT APPROVAL OF THE CITY COUNCIL, upon the conditions of the Reserve for Contingencies, and no new services. 4- CONSENT AGENDA 1TEM #16675 Councilman Baum requested the Ordinance to amend and reordain Section 17-15 of the City Code relating to litter from motor vehicles be "pulled" from the Consent Agenda. The City Manager advised Council he was going to "pull" that Ordinance for further study, and the Resolution reserving land for Civic Leagues or Homeowners Association. Councilwoman Henley advised Council she had some questions concerning the Ordinance to amend and reordain Section 23-48 of the City Code relating to sleeping in automobiles. The items to be removed from the Consent Agenda are: 8. Resolution - Reserving land for Civic Leagues or Homeowners Association for a period of five (5) years by developers. 11. I N F 0 R M A L A G E N D A FRANK BUTLER/EXPEDITING ITEM #16676 The City Manager advised he received a request from Frank Butler to have his application expedited due to an error in advertising. The application is for a change of zoning from R-6 Residential District to A-2 Apartment District. This matter will be placed on the FORMAL AGENDA for further discussion and vote. STATUS OF WELLS ITEM #16677 Aubrey V. Watts, Jr., Director of Public Utilities, presented a status report on the wells under construction, and advised that three wells, two in Suffolk and one in Isle of Wight, have been completed. Testing of the Suffolk well will begin this afternoon, (May 18, 1981). A copy of the report will be made a part of these proceedings. 5- ITEM #16678 The City Manager advised he may call a Special Meeting of Council for the purpose of authorizing him to sign the water contract with, the City of Norfolk. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That: Section 33-47 of the Code of the City of Virginia Beach is hereby amended and reordained as follows: DIVISION 4. TAX ON TRANSIENTS OBTAINING BOARD-OR-LODGING IN HOTEL, ETC., CHARGING THEREFOR Section 33-47. Definitions. Except where the context clearly indicates a different meaning, tbe following words and phrases, when used in this division shall, for the purposes of this division, have the following respective meanings: Beard-enel Lodging: "Lodging" means any room or rooms, lodging or space furnished to any transient. City Treasurer: "City Treasurer" means the Treasurer of the City and any of his duly authorized Deputies and Agents. Commissioner of Revenue: "Commissioner of Revenue" means the Commissioner of the Revenue of the City and any of his duly authorized Deputies and Agents. Hotel: "Hotel" means any public or private hotel, inn, hostelry, tourist home or house, tourist camp, tourist cabin, camping grounds, motel, rooming house or other lodging place within the City offering @eard-an& lodging, e-lther-&L--beL-h, as defined in this Section, for compensation, to any transient as defined in,this Section. -1 8- .Person: "Person" means any individual, corporation, company, association, firm, copartnership or any group of individuals acting as a unit. Special Tax Auditor: "Special Tax Auditor" means the Special Tax Auditor of the City and any of his duly authorized Deputies or Agents. Transient: "Transient" means any person who, for any period of not more than 9-imey-460@ ninety (90) consecutive days, either at his own expense or at the expense of another, obtains 15&ai-d-amel lodging in any hotel. This Ordinance shall become effective on,June 1, 1981. Merrick 2 2- AN ORDINANCE TO AUTHORIZE A TEMPORARY ENCROACHMENT INTO A PORTION OF THE RIGHT-OF-WAY OF VANDERBILT AVENUE TO LUKE BIERNOT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That pursuant to the authority and to the extent thereof contained in Section 15.1-893, Code of Virginia, 1950, as amended, Luke Biernot, of Lot 6, Block 19, Croatan Beach is authorized to construct and maintain a temporary encroachment into the right-of-way of Vanderbilt Avenue.
