1. Deferred Items
a. Application of Hayden R. and Patrick S. McQuilkin
for a conditional use permit for a single-family
dwelling on a 5.145-acre,parcel located on the
south side of Drum Point Road, east of Muddy Creek
Road (Pungo Borough).
This matter was deferred for one week on January 19,
1981, and for an additional week on January 26, 1981.
1. Letter from the City Manager transmits the
recommendation of the Planning Commission for
approval.

1. First Readings
a. Ordinance, on first reading, to appropriate funds
of $76,000 for an i-nventory and valuation of County
and Kempsville Utilities, Inc.
b. Ordinance, on first reading, to appropriate funds
of $35,667 to Txten@ a specialized mental health
grant for emotionally handicapped students.
C. Ordinance, on first reading, to appropriate $29,356
for payment for the Norfolk Adult Offender Tr,ns-
action Statistics and Management Information System
(TRACER) for the period January 1, 1980, through
June 30, 1980.
2. Low Bids
a. Low bid of Vico Construction Company, in the amount
of $223,796.30 for the Birdneck Road to Atlantic
Avenue 24-Inch Waterline Project, and authorize the
City Manager to enter into the necessary agreements
for the implementation of this project. Funds are
available.
b. Low bid of Van de Riet Construction Company, Inc.,
in the amount of $52,187.00 for the Lakecrest
Sewage Pumping Station Project, and authorize the
City Manager to enter into the necessary agreements
for the implementation of this project.

The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., in the
Conference Room, in the City Hall Building, on Monday, 2 February
1981, at 12:30 in the afternoon.

Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. Discussion or consideration of employment, assignment,
appointment, promotion, demotion, salaries, discipline or
resignation of public officers, or employees of any public
body. (Personnel Matters).
2. Discussion or consideration of the condition, acquisition
or use of real property for public purpose, or other disposition
of publicly held property. (Acquisition, use or disposition of
publicly held property).
3. Consultation w-lth legal Counsel and briefing by staff
members, consultants, or attorneys pertaining to actual or
potential litigation, or other legal matters within the
jurisdiction of the public body. (Legal Matters).

the INFORMAL SESSION.

Mayor McCoy advised Council of an article in the BEACON concerning the
water situation, and requested Council to "work togetber" on this very
serious matter.
ITEM #16187
Mayor McCoy advised Council that House Bill 1680 was being introduced
in the General Assembly by Delegate Moss. The Bill makes reference
to Transportation Districts and trips across City-boundaries, and
could be very detrimental to TTDC services

Mr. Ivan D. Mapp, member of the Eastern Virginia Medical Authority,
introduced Doctor William D. Mayer, President of the Authority, and
Doctor M. Bagley Walker, D.D.S. Mr. Mapp also introduced Mr. Vern
Jones.
Doctor Mayer presented the Authority's Annual Report by slide
presentation, and his written report has been made a part of
these proceedings.
Mayor McCoy advised Council that Doctor Louis Guarnieri, Health
Department Dentist, has a new dental trailer behind Seatack
Elementary Scbool and invited all Council Members to inspect the
trailer and equipment.

Discussion on the Flag Lots Reviewed on a Variance Basis during 1980
was deferred until the Council meeting of February 9, 1981.

Councilman Baum advised Council of a revised letter received from
Mr. Myers regarding the request of Seabreeze Farm for a Subdivision
Variance, which was denied by City Council 12 January 1981.
Councilman Baum requested the Planning Director to discuss with Council
tbe altetnate plans.
It was the consensus of Council that no action be taken at this time.

ITEM #16190
Councilwoman Oberndorf advised Council of a "Concept Paper" prepared by
Old Dominion University which discusses the feasibility of generating
cost savings through the consolidation of "comparable" City and School
functions.
Councilwoman Oberndorf advised, out of courtesy, she would send her
"Concept Paper" to Doctor Brickell and the School Board before asking
Council for specific action or hiring a third party consulting firm by
the Council. This action is planned for 23 February 1981.
A copy of the report has been made a part of these proceedings.
ITEM #16191
Councilman Merrick requested the Ordinance concerning the sale of
food from a motor vehicle be brought back to Council before the
summer season begins.
The City Manager advised Council that the Ordinance will be on the
Council Agenda of February 9, 1981.
ITEM #16192
Councilman Ervin made reference to a letter received from Fred Bates,
Director of Family Protection Services of America, who wished Council
to reconsider the $50,000 Consumer Education Grant.
This matter will be heard under UNFINISHED BUSINESS.

WHEREAS, over the past several years, officials of the Navy
and the City of Virainia Beach have worked in close cooperation to strive
for compatibility between the development of our growing community and
operations at NAS Oceana; and
WHEREAS, the Navy has produced the Air Installation Compatible
Use Zone (AICUZ) program to provide recommendations for land uses compatible
with the degree of accident potential and varying noise levels in those
areas surrounding Oceana; and
WHEREAS, the AICUZ program, which includes federal acquisition
of restrictive easements around NAS Oceana, represents a sound approach
to protecting the overall interests of the citizens of Virginia Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That Congress be urged to appropriate adequate money for the
Navy to acquire restrictive easements around NAS Oceana to protect the
base and control development in the area.

SECTION 2-7 OF THE CODE OF THE CITY
OF VIRGINIA BEACH, VIRGINIA, RELATED
TO REGULAR MEETINGS GENERALLY, WHEN
AND WHERE HELD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
Sec. 2-7. Regular meetings generally-When and where held.
Regular meetings of the council shall be held in the administration
building, Municipal Center, Virginia Beach, Virginia, on the first, second
and third Mondays at I-.00- 12:30 p.m. and on the fourth Monday of each montb
at 5:30 p.m., unless such date shall fall upon a legal holiday, in which case
the meeting will be held on the next succeeding day which is not a holiday
and at the same hour except as otberwise provided by special resolution of
the council. However, in July of each year, there shall be regular meetings
only on the first two (2) Mondays of the month.
This ordinance shall become effective upon date of adoption.

AN ORDINANCE TO AMEND AND REORDAIN
ARTICLE IV CHARITABLE SOLICITATIONS,
SECTION 18-41 SUBSECTION (a)(3) OF
THE CODE OF THE CITY OF VIRGINIA
BEACH PERTAINING TO EXEMPTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That Section 18-41 Subsection (a)(3) is amended and
reordained as follows:
Section 18-41. Exemptions.
(a)(3) Charitable organizations which do not intend to
solicit and receive, during a calendar year, and have not
actually raised or received, during any of the three next
preceding calendar years, contributions from the public in excess
of twe five thousand dollars or which do not receive
contributions from more than ten persons during a calendar year,
if all of their functions, including funding raising activities,
are carried on by persons who are unpaid for their services and
if no part of their assets or income inures to the benefit of or
is paid to any officer or member. Nevertheless, if the
contributions raised from the public, whether all of such is or
is not received by any charitable organization during any
calendar year, shall be in excess of two five thousand dollars,
it shall, within thirty days after the date it shall have
received total contributions in excess of two five thousand
dollars, register with and report to the city manager as required
by this article.
Adopted by the Council of the City of Virginia Beach on
the 2nd day of February 1981.

AN ORDINANCE AUTHORIZING CERTAIN
EVENTS CONDUCTED ON CITY PROPERTY
TO BE EXEMPTED FROM THE PROHIBITION
FROM WORKING OR TRANSACTING BUSINESS
ON SUNDAY
WHEREAS, Section 18.2, Code of Virginia (1950) as amended, requires
the City Council of the City of Virginia Beach to designate on a case-by-
case basis the events which are exempt from working or transacting business
on Sundays; and
WHEREAS, the following city property has been designated by the
Council of the City of Virginia Beach for the following dates, as the
site for the following events:

The City Manager requested Council's approval to "delay enforcement
of personal property auto decals until Wednesday, February 4, 1981."
The City Attorney advised Council this matter needs to be discussed
further when Council returns today to the EXECUTIVE SESSION.

no Formal Action was taken before meeting adjourned.

the City Council approved an appropriation on January 5, 1981
for the Department of Mental Health and Mental Retardation (@/MR) to extend
the program providing spe--i-aiized mental health clinical treatment and suppor-t
services in the City's Public School Special Education Program for emtionally
handicap@ students, and
WHEREAS, the state DMH/MR has awarded a grant in the aniount of $35,667
to extend this program through June 30, 1981.

WHEREAS, that in order to establish a uniform Fiscal Year for
the contract between tbe City of Norfolk and the City of Virginia Beach
for the Norfolk Adult Offender Transaction Statistics and Management
Information System (TRACER), a conversion period of January 1, 1980
through June 30, 1980, has been established, and it is necessary to
appropriate sufficient funds to cover said period.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
That the amount of $29,356 be appropriated for payment for use

Mr. Fred Bates, Director of Family Protection Services of America,
appeared concerning the Consumer Education Grant, which was denied
by City Council 26 January 1981.
Mr. Bates requested an appearance before Council to discuss his
reasons for approval of the Grant.
It was the consensus of Council to permit Mr. Bates to appear before
Council 9 March 1981.
ITEM II-1.2 ITEM #16207
Councilwoman Henley advised Council that several months ago Council
had requested additional information on the selection of Architects
and Engineers for the City of Virginia Beach.
The City Manager advised Council that he directed the Public Works
Director to modify the City Policy regarding the selection of
Architects and Engineers to read, "all things being equal the City
would favor a local Engineer or Architect."
Councilwoman Henley requested a verbatim of the meeting of 14 July 1980
concerning the above matter.

Mayor McCoy entertained a motion to permit Council to RECESS into
EXECUTIVE SESSION for discussion of the following:
