1. Ordinance to authorize the acquisition of right-of-way for
Lynnhaven Parkway, property to be acquired in fee simple; the
acquisition of right-of-way either by agreement or by condem-
nation.
2. Ordinance to authorize the acquisition of permanent utility
easements for Cape Story 13y The Sea sanitary sewer system and
temporary easements of right-of-way, either by acjreement or by
condemnation.
3. Ordinance to authorize the acquisition of permanent utility
easements for Cape Henry Shores sanitary sewer system and tem-
porary easements of right-of-way, either by agreement or by
condemnation.
4. Ordinance, on @ond in , to authorize the City Manager to
accept a grant from the United States Department of Agriculture
(USDA), and to appropriate these funds in the amount of $11,082.

tax exemption for certain elderly and handicapped persons.
b. ordinance to amend Chapter Two of the Code of the City of
Virginia Beach by adding Article XXV thereto creating the
Office of Emergency medical Services.

The Regular Meeting of the Council of the City of Virginia Beach, Virginia,
was called to order by Mayor J. Henry McCoy, Jr., in the Conference Room,
City Hall Building, on Monday, April 13, 1981, at 12.35 p.m.

CONDITIONAL USE PERMITS ITEM #16506
Councilman Merrick requested the City Manager to discuss Conditional
Use Permits.
The City Manager advised that at last week's Council Meeting (6 April 1981),
Councilman Merrick distributed to each Council Member a letter requesting
the Planning Commission re-examine standards for certain use permits
and eliminate as many uses requiring them as possible from the Zoning
Ordinance and place those uses in a proper zoning district as a matter
of right.

DESALINAZATION PIANT ITEM #16507
Aubrey V. Watts, Jr., Director of Public Utilities, introduced Mr. William
Love, Vice President of Malcolm Pirnie, Inc., who presented a report on the
Desalting Project, (reverse osmosis).
Mr. Love advised Council that in preparing the report careful evaluation
was given to all the cost elements that would be associated with this
project from the brackish raw water supply to and including the feeding
of treated water into the distribution system.
Th6 total project costs represent the estimated construction cost of all
estimated cost of land, all technical services through start-up, financial
costs and an allowance for contingencies. Construction Costs have been
indexed at an inflation rate of 18 percent per year to permit adjustment
to actual project time.
It is estimated that all facilities can be in operation within 18 months
of project initiation. Assuming an initiation date of May 1, 1981,
facialities could be in operation by October 31, 1982. With this schedule,
it is estimated a capital project cost for a single 10 mgd treatment plant
of $25,450,000.
It is requested that the well sites be moved to the West Central portion
of the City.
Mr. Garret Westerhoff spoke on this matter also.

BURTON STATION LAND USE PIAN ITEM #16508
Benjamin Moore, Director of Housing and Community Development, introduced
Harold Hubbard, Housing Planner with the Department of Housing and
Community Development. presented to Council a report on the Overview
of the Burton Station Planning Process, and introduced Tim Barrow of
Tim Barrow and Associates.
Mr. Barrow advised Council that research was done to understand the present
and future impact that the Norfolk Airport, Virginia Beach Industrial
Authority, and the business community have on Burton Station, and research
was done to find financing resources that were presently available to
fund any physical development activities that might be included in a
development plan for the neighborhood.
Mr. Barrow presented Alternative Conceptual Land Use Plan for Burden
Station:
Alternative One
New residential entrance on Northampton Boulevard
Increased residential area from 33.5 to 59.8 acres
Maximum use of lako and golf course exposures for
residential use
Use of VEPCO right-of-way as transition from commercial
to residential
Separation of residential and industrial/airport traffic
and industrial park
Addition of 68.6 acres to industrial park
Full use of railroad for industrial use
Alternative Two
Separation of industrial and residential traffic
Maximum industrial development potential preserving
adequate residential sites for relocation
Addition of 107.3 acres to industrial park
Partial filling of borrow lake
No change in residential area
New residential entrance to Northampton Boulevard
No area provided for additional housing in coumunity
other than relocation
Alternative Three
Increase in residential area from 33.5 to 76.7 acres
No use of south side of railroad for industrial

The City Manager presented a Policy for the Procurement of Professional
Architectural and Engineering Services by the City of Virginia Beach.
This matter will be presented to Council on 20 April 1981.

PROPOSED POLICY/LARGE GATHERINGS ITEM #16510
The City Manager presented to Council a proposed Ordinance to add
Section 20-19.1 to the Code of the City of Virginia Beach, pertai-ni-ng
to public meetings, addresses and demonstrations in public parks and
faci-lities.
This matter will be placed on the Council Agenda of April 20, 1981.
A copy of the proposed Policy has been made a part of these proceedings.

the meeting place be changed from the Council Chambers to a larger
facility.
@s. Ryan also requested Council reconsider their action of April 7,
1981, to hold the Public Hearing on the Budget in the Council Chambers.
Mrs. Margaret Kiernan, President of the PTA Council of Virginia Beach,
spoke before Council requesting an additional Public Hearing regarding
the Budget, and that it be held in a larger facility at a more convenient
time.
Upon motion by Councilman Ervin, seconded by Councilwoman Oberndorf, City
Council voted to RECONSIDER the time and place for the Public Hearing on
the proposed Budget.

WHEREAS, the Young Women's Christian Association has been
making a difference in the lives of women of all ages for over 12
decades, and for 100 years has focused particular attention on moving
teenage girls into responsible leadership roles by way of designing
and implementing special YWCA-Teen programs; and,
WHEREAS, YWCAs in over 400 cities around the Country offer
a wide range of services designed to enhance the total woman, including
traditional and non-traditional job training, social development
programs, day care facilities, career advancement, and leadership
opportunities and battered women's shelters; and,
WHEREAS, these women and girls are, within the framework of
the YWCA, actively involved in and committed to building better
communities by working to advance the cause of peace, justice, dignity,
and the elimination of racism and sexism;
NOW, THEREFORE, I. J. Henry McCoy, Jr., Mayor of the City

AN ORDINANCE TO AUTHORIZE THE
ACQUISITION OF RIGHT-OF-WAY FOR
LYNNHAVEN PARKWAY, PROPERTY TO BE
ACQUIRED IN FEE SIMPLE: THE ACQUISITION
OF RIGHT-OF-WAY EITBER BY AGREEMENT OR BY
CONDEMNATION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
WHEREAS, the Council of the City of Virginia Beach, Virginia,
has authorized the Lynnhaven Parkway Project and has approved same for
right-of-way acquisition; and,
WHEREAI:, i.n the opinion of the Council of the City of Virginia
Beach, a public necessity exists for construction of this important project
for the preservation of the safety, health, peace, good order, comfort,
convenience, morals and for the welfare of the people in the City of
Virginia Beacli.
NCW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
Section 1. That the City Attorney is hereby authorized to
acquire by purchase or condemnation pursuant to Section 15.1-236, et seq.,
15.1-898, and 15.1-899, et seq., and Section 25-46.1, et seq., and
1.2E,ction 33.1-89, et seq., Code of Virginia of 1950, as amended, all that
certain real property, in fee simple, including temporary and permanent
easements of right-of-way as shown on the Plans & Profiles of Proposed
Construction of Lynnhaven Parkway, and on file in the Office of Real
Est@trz, Department of Public Works, Virginia Beach, Virginia.
Section 2. That the City Attorney is hereby authorized to make
or cause to be made in behalf of the City of Virginia Beach, to the extent
that funds are available, a reasonable offer to the owners or persons
having an interest in said lards, if refused, the City Attorney is hereby
authorized to institute proceedings to condemn said property.

Section 3. That an emergency is hereby declared to exist
and this Ordi-nance shall be in force and effect from the date of its
adoption.

WHEREAS, the USDA has agreed to reimburse 100% of Pendleton

AN ORDINANCE TO AMEND CHAPTER TWO OF THE
CODE OF THE CITY OF VIRGINIA BEACH BY ADDING
ARTICLE XXV THERETO CREATING THE OFFICE OF
EMERGENCY MEDICAL SERVICES
P R E A M B L E
WHEREAS, the City of Virginia Beach receives necessary and
valuable pre-hospital emergency patient care services on a continuous
basis from dedicated members of independently operated volunteer rescue
squads, saving the City of Virginia Beach thousands of tax dollars; and,
WHEREAS, volunteer physicians, due to both moral commitment
and State legal requirements, have joined in this effort to provide
direction to this pre-hospital patient care delivery system; and,
WHEREAS, it has become apparent that, with the growth of this
service, the increase in citizen needs and expectations, and the medico-
legal problems in providing this Service, it is necessary and desirable
that a further strentghening of the association between the volunteer
rescue members, the volunteer Medical Directors and the City of Virginia
Beach be effected while continuing this unique concept of emergency patient
care delivery; and,
WHEREAS, the Council of the City of Virginia Beach desires that
an Ordinance be instituted creating an Office of Emergency Medical
Services which provides for policy making direction by the volunteer
Medical Directors with active participation by the volunteer rescue
organizations in the development of these policies, and the continued
participation of the volunteer rescue squad members as principal providers
of emergency pre-hospital patient care services while allowing such
volunteer rescue organizations to remain independent in conducting their
general business and administrative functions.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That Chapter Two of the Code of the City of Virginia Beach
is hereby amended to provide an Office of Emergency Medical Services
as follows:

ARTICLE XXV. OFFICE OF EMERGENCY MEDICAL SERVICES
Section 2-153. Creation; Composition.
There is hereby created an Office of Emergency Medical Services,
which shall consist of Medical Directors endorsed by the Virginia Beach
Medical Society; the Council of Virginia Beach Volunteer Rescue Squads,
Inc.; the Operational Volunteer Rescue Squads serving the City; and, an
Office Coordinator, with staff as necessary. The Medical Directors and
Coordinator shall be appointed by the City Manager with approval of City
Council. The Medical Directors of the Office shall serve in such positions
without compensation.
Section 2-154. Functions.
The Office of Emergency Medical Services shall be responsible
for the provision of proper emergency patient care se,rvices to protect
and promote the health, welfare, and safety of the general public a-nd
shall have such other powers and duties as may be assigned by Council.
Section 2-155. Medical Directors.
The Medical Directors shall make rules, regulations and policies
concerning the operation of the Office including: the@development and
direction of emergency patient care operations and standards; the
certification of Emergency Medical Services personnel to operate within
the City; and, the supervision of all certified Emergency Medical Services
personnel. Such rules and regulations shall be approved by the City
Manager and shall not be inconsistent with the laws of the Commonwealth.
Adopted by the Council of the City of Virginia Beach, Virginia,
on the Thirteenth day of April .1 1981.
This Ordinance shall be in effect from date of its adoption.
