As prescribed by Section 3.06 of the City Charter, Section
2-9 of the City Code and by motion of CounciZman standing at
the regutar meeting Aprit 13, 1981, the Virginia Beach City
CounciZ voted to meet in Speciat Session in the Councit Chambers
at 7:00 p.m. on Tuesday, ApriZ 14, 1981.
The purpose of this meeting wiZZ be to make a public state-
ment concerning the water crisis and the Moratorium for water
meter connections within the City of Virginia Beach.

The Special Meeting of the Council of the City of Virginia Beach, Virginia,
was called to order by Mayor J. Henry McCoy, Jr., D.D.S., in the Council
Chambers, in the City Hall Building, on Tuesday, 14 April 1981, at Seven
o'clock in the evening.
Council Members Present:
John A. Baum, F. Reid Ervin, Vice Mayor Harold Heischober,
Barbara M. Henley, Clarence A. Holland, M.D., W. H. Kitchin,
III, Reba S. McClanan, Mayor J. Henry McCoy, Jr., D.D.S.,
Dmald W. @rrick, @yera E. Oberndorf, and Patrick L. Standing

The City Clerk read the Notice of Public Hearing:

the Virginia Beach City Comcil voted to met in Special Session

Mayor McCoy advised Council that the Council's Clearing Committee will
continue to meet. The name of the Committee has been changed to "Council's
Citizen Advisory Committee". There will be no Agenda, and no minutes;
however, if any Member of Council wishes to attend the meetings they may
do so.

Mayor McCoy advised Council that it is a privilege a-nd prerogative
of the elected presiding Officer of City Council to move citizens
forward on the Agenda unless the majority of Council objects.

The City Manager read the following statement:
"On October 22, 1980, Governor Dalton issued an energency declaration
due to the severe @ter shortage being experienced by all of Tidewater.
On this mm date, I instructed officials of the Depar@t of Public
Utilities to cease hooking up new custoners to otx water system. As

approxiTmtely six (6) rmnth s passed since I initiated this water
hookup ban, I thought it was appropriate for @ to re-examine this
Policy.
"At the tinie of the ban's hposition, I stated: 'The seriousness of
this water crisis leaws m no other alternative than to initiate this
action.' Our solirce of water was at an alarming 75-day supply and,
figuratiwly and literally, no rain was in sight.
"Since this tirae, I haw followed the umter developrmnt chronology
adapted by Council at its January 29, 1981 rweting. Agre@ts haw
been negotiated with Isle of Wight, southanptm County, and the City
of Suffolk. The result: five (5) wlls being deneloped with a
carrbined production lewl of 20 million gallons per day. The cost:
$2 Mi-Ilicn. The target date for service: the end of June 1981.
"Negotiations continue with the City of Ncrfolk. I learned today that
the City Council of Norfolk agreed to transport, treat, and deliver the
uster w will have from our five (5) vrlls and, furthermre, that as
long as we retwin within our 75% allocatim, no penaltips will be
assessed. This action is most wl@ , to say the least.
"In light of this recent de-velopnent, but unre iniportantly, considering
that we now ha-ve a 200-day vmter supply; considering that we will soon
have all fiw (5) wlls producing water; and, cmsidering that our
economy has been directly and drawtically affected by the ban on water
taps; I muld like to Tmdify the current water tap ban.
"Specifically, I am lifting the water tap ban as of tcrmrrow, April 15,
1981. As the attached Ordinances indicates, I am proposing a $50.00
increase in the one-inch tap/imter fee and a $100 increase for imters
larger than one-inch in size. This increase will generate $150,000 in
additional re-veune over a 12-rmnth period. It is anticipated that this

"reven@ will mre than offset the cost of de-velcping frcm existing
borrow pits a 2,000,000-gallon per day supply. In additim, it would
fund operation of the borrow pit system and help offset the cost of
wll developnient. This swply will be available by the summer. At
@he end of tw years, or at the end of the drought - whiche-ver comes
last - I wuld eliminate this increase.
"I am authorizing this Policy cbange for four reasons only:
1. The availability of water has increased substantially.
2. Tbe ad-verse effects of the ban upon the City's economy.
3. The devastating effect of this ban on tbe small builder
and his employees that risks his life's incorm.
4. Norfolk's agreeing to transport, treat, and deliver our
@ll water.
"No one should feel tbat the water crisis bas ended. No one should
belie-ve he or she has all the water needed. Conservation @t con-
tinue, as will my efforts to achieve an adequate supply of water for
our citizens. "
Mr. Frank Smith, Executive Director of the Tidewater Builders Association,
spoke on this matter.
Upon motion by Vice Mayor Heischober, seconded by Councilman Ervin, City
Council voted to uphold the recommendation of the City Manager and ADOPT
the Ordinance to amend Section 37-29 of the Code of the City of Virginia
Beach, Virginia, to provide for a Water Resource Impact Fee.
Voting: 8-3

AN ORDINANCE TO AMEND SECTION 37-29
OF THE CODE OF THE CITY OF VIRGINIA
BEACH, VIRGINIA, TO PROVIDE A WATER
RESOURCE IMPACT FEE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
That Section 37-29 of the Code of the City of Virginia Beach,
Virginia, is hereby amended to read as follows:
Section 37-29. Connection and installation fees:
(a) Connection to a City water line (tap fee):
3/4-inch tap and 5/8-inch meter . . . . . . . $220.00
1-inch tap and meter . . . . . . . . . . . . $285.00
11/2-inch or larger tap and meter . . . Cost of labor, materials
and equipment plus 25%
for administration.
5/8-inch or 3/4-inch meter and appurtenances
only . . . . . . . . . . . . . . . . . . . . $120.00
1-inch meter and appurtenances only . . . . . $185.00
11/2-inch or larger meter and appurtenances
only . . . . . . . . . . . . . Cost of labor, materials
and equipment plus 25%
for administration.
When the installation requires a combination of a different size
tap and meter than listed above, the charges will be based on cost of
labor, materials and equipment plus twenty-five (25%) percent for
administration. All meters purchased for connection to the City water
system shall be charged a Water Resource Impact Fee of FIFTY ($50.00)
DOLLARS each for meters one (1) inch in size or smaller and OND HUNDRED
(100.00) DOLLARS each for meters larger than one (1) inch in size.
For taps in excess of one (1) inch, an amount shall be placed
in escrow shall be based on an estimate of costs by the Director of
Public Utilities.
Adopted by the Council of the City of Virginia Beach, Virginia,
on the Fourteenth day of April, 1981.
