CONSENT AGENDA All matters listed under tbe Consent Agenda are considered to be routine by tbe City Council and will be enacted by one motion in the form listed. Tbere will be no separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and considered separately. 1. Resolution requesting the State Highway Commissioner to acquire the necessary rights-of-way for Newtown Road Project UOOO-134-107 and Haygood Road Project UOOO-134-107 and convey the title to such rights-of-way to the City of Virginia Beach upon completion of the project. 2. Ordinance to authorize acquisition of property in fee simple for right-of-way for the intersection of Oceana Boulevard and Virginia Beach Boulevard Project No. 2-816 and the acquisition of temporary and permanent easements of rights-of-way, either by acquisition or by condemnation. 3. Request of the Commissioner of the Revenue for license refunds in the amount of $767.50. 4 . Request of the City Treasurer for tax refunds in the amount of $1,058.13. 5. Ordinance, on second reading, to appropriate $13,775 to ext nd a specialized Mental Health Grant for emotionally handicapped students. 6. Ordinance, on second reading, to appropriate funds from the outheastern Virginia Areawide Model Program (SEVAMP) 7. Henry McCoy, Jr., in the Conference Room, in the City Hall Building, on Monday, January 5, 1981, at One o'clock in the afternoon. Council Members Present: John A. Baum, F. Standing ITEM #16044 Mayor McCoy entertained a motion to permit Council to conduct its INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the purpose of discussing the following: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, salaries, discipline or resignation of public officers, or employees of any public body. (Personnel Matters). 2. Discussion or consideration of the condition, acquisition or use of real property for public purpose, or other disposition of publicly held property. (Acquisition, use or disposition of publicly held property). 3. Discussion concerning the prospective business or industry where no previous announcement had been made of the business or industry's interest in locating in the connnunity. (New Business). 4. Mayor McCoy requested Council to adopt an Ordinance concerning this matter at the next Council meeting, (January 12, 1981). " M A T T E R S B Y C 0 U N C I L M E M B E R S ITEM #16047 Councilwoman McClanan advised Council of the Ordinance concerning the removal of submerged steel debris and pilings at the former site of the Steel Pier; and requested the followi-ng wording be placed in future Ordinances, such as these: '!Any item is the respcnsibility of the perscn who @d it, and initially placed it there." 'Mv City is not liable for the remval of debris, such as pilings and piers, as they are the soul respcnsibility of the @r. " The City Attorney advised Council he will study the matter and bring it back to Council for their consideration. I N F 0 R M A L A G E N D A ITEM #16048 The City Manager advised Council of a letter in the "For Your Information" section of the Agenda concerning the bids of Bond Anticipation Notes, in the amount of $21,500,000. The low bidder was Citibank, N. A. with an effective bid of 8.3725%. ITEM #16049 The Planning Director advised Council of the request for a modification to the Master Street and Highway Plan in conjunction with the construction of the Fox Fire Subdivision, by the reduction of the Goodman Road right-of-way from a 66-foot right-of-way to a 60-foot right-of-way (four-lane, undivided highway). This matter will be forward to Council at a later date for vote. - 5- ITEM #16050 The Director of Public Utilities appeared before Council in the INFORMAL SESSION to advise Council of the City's net water consumption from 1977 through 1980; and, further advised that as of January 1, 1981, four (4) of the four (4) Nottoway River pumps were in operation, and two (2) of the four (4) Blackwater River pumps were in operation. (A copy of the report will be made a part of these proceedings). The City Manager advised Council that during the winter season the City will be keeping track of the status of the water supply system and it is anticipated the City will be requesting the Innkeepers to advise the incoming tourists of the City's need for water conservation. It is suggested the increased water rates be advertised in the BEACON for clarification to the citizens of Virginia Beach. ITEM #16051 Councilwoman Oberndorf made reference to a letter received from Doctor W. B. Crawford, Regional Medical Director, concerning "treated water" and supplementing the water purchased from the City of Norfolk with well fields. Standing -8- P U B L I C H E A R I N G S ITEM II-E.1 ITEM #16053 The following appeared concerning the PUBLIC BEARING to consider proposed Amendments to the Charter of the City of Virginia Beach, said Amendments, if approved, to be submitted to the 1981 Virginia General Assembly: Mrs. Martha Kessler was in favor of the proposed Amendments to the City Charter; however, she did have some questions concerning the Advisory Referendum. Mr. Richard J. Webbon, Council of Civic Organizations, was in favor of the proposed Amendments to the City Charter; however, he felt the term of the Mayor should be four (4) years instead of the two- (2) year term now in effect. Mrs. Helen Love was in favor of the Amendments to the City Charter. Upon motion by Councilman Baum, seconded by Councilman Holland, City Council voted to ADOPT "Alternative B", as amended -- the Resolution as submitted in the Agenda this date deleting the wording: "Such anuunt as the Counci-I nay determine not to exceed" relating to COMPENSATION OF MEMBERS OF City Council: Voting: 10-0 Council Members Voting Aye: John A. Standing - 9- R E S 0 L U T I 0 N WHEREAS, it is the opinion of the Council of the City of Virginia Beach, Virginia, that the following amendment needs to be made to the Charter of the City of Virginia Beach, Virginia; and, WHEREAS, in order to make this amendment, legislative action is required by the General Assembly of Virginia; and, WHEREAS, a public hearing was held after due notice of the same and the proposed Charter Amendment in accordance with Section 15.1-835 of the Code of Virginia, 1950, as amended: THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That the General Assembly of Virginia is roquested to make the following amendment to the aforementioned Charter: AN ACT TO AMEND CHAPTER 147, AS AMENDED, OF THE ACTS OF ASSEMBLY OF 1962, WHICH PROVIDES A CHKRTER FOR THE CITY OF VIRGINIA BEACH, VIRGINIA, BY CHANGING SECTION 3.04 OF THE CHARTER OF THE CITY OF VIRGINIA BEACH, VIRGINIA, RELATING TO COMPENSATION OF MEMBERS OF CITY COUNCIL. BE IT ENACTED BY THE GENERAL ASSEMBLY OF VIRGINIA: That Chapter 147, as amended, of the Acts of Assembly of 1962, which provides a Charter for the City of Virginia Beach, Virginia, be amended by changing Section 3.04 of the Charter of the City of Virginia Beach, Virginia, as follows: Section 3.04: Compensation of Members of Council; appointment of Members to office of profit. Councilmen shall receive as compensation for their services $8,000.00 $4999 per annum for Councilmen and $10,000.00 $8999 per annum for the Mayor. No member of the Council shall be appointed to any office of profit under the City Government during the term for which elected and for one year thereafter. BE IT FURTHER RESOLVED that the City Clerk is directed to forward a copy of this Resolution to each member of the General Assembly representing the City of Virginia Beach, Virginia. BE IT ENACTED BY THE GENERAL ASSEMBLY OF VIRGINIA: That Chapter 147, as amended, of the Acts of Assembly of 1962, which provides a Charter for the City of Virginia Beach, Virginia, be amended by changing Section 3.07 of the Charter of the City of Virginia Beach, Virginia, as follows: Section 3.07. Selection and duties of Mayor and Vice-Mayor. On or after July 1, 1981, the Mayor shall be elected by direct election of the voters for a term of two (2) years. Any member of Council or any qualified candidate therefore, may declare themselves a candidate for Mayor by filing in a manner prescribed by General Law. The candididate for Mayor receiving the highest number of votes shall be Mayor, provided, however, that he or she shall first be elected to Council. At the first meeting of the term following the General Election of Council Members, the Council shall choose, by a majority vote of all members thereof, one of its members to be Vice-Mayor. The Mayor shall preside over the meetings of the Council, shall act as head of the City Government for ceremonial purposes and shall.have such other rights and duties as the Council may prescribe, in addition to all the rights and privileges of Council -12- Members re@eilmen of the City. The Vice Mayor shall perform the duties of Mayor in the absence or disability of the Mayor. BE IT ENACTED BY THE GENERAL ASSEMBLY OF VIRGINIA: That Chapter 147, as amended, of the Acts of Assembly of 1962, which provides a Charter for the City of Virginia Beach, Virginia, be amended by changing Section 3.09 of the Charter of the City of Virginia Beach, Virginia, as follows: Section 3.09. Advisory Referendums. Upon the filing with the Clerk of the Circuit Court of the City of Virginia Beach, of a petition signed by a number of qualified voters in Virginia Beach equaling twenty-five percentum of the number of voters voting in Virginia Beach at the last Regular Election, as certified by the City Registrar, the Chief Judge of the Circuit Court of the City of Virginia Beach shall, by order of records, call for Advisory Referendum taking the sense of the voters on the question proposed in the petition at the next succeeding Regular Election. The Referendum shall be conducted in accordance with the provisions of Section 24.1-165 of the Code of Virginia, 1950, as amended. Following certification of the election results by the Electorial Board to the Chief Judge, the Court shall enter an order proclaiming the results of such election and a duly certified copy of -15- such order shall be transmitted to the governing body. BE IT FURTHER RESOLVED that the City Clerk is directed t6 foward a copy of this Resolution to each member of the General Assembly representing the City of Virginia Beach, Virginia. Adopted by the Council of the City of Virginia Beach, Virginia, on the Fifth day of January, 1981. -16- ITEM II-E.4 ITEM #16056 Attorney Sam Houston appeared before Council requesting his client, Resort Satellite Communications, be permitted to operate a Cable Television system from Third Street to Cavalier Drive, in the Virginia Beach Borough. Mrs. Alice Mullen, President of Resort Satellite, appeared in favor of the request. Mr. Roger Pierce, Division Vice President for Cox Cable Television, appeared concerning this matter. Upon motion by Councilman Kitchin, seconded by Councilwoman Oberndorf, City Council declared there is a need for a second Cable Television Franchise along the Oceanfront from Third Street to Cavalier Drive, in the Virginia Beach Borough. It was noted that a Public Hearing on the above matter will be held on January 19, 1981, at 2:00 p.m. Voting: 10-0 Council Members Voting Aye: Jolm A. Baum, F. The City of Virginia Beach agrees to reimburse the State Highway Department for five (5%) of all costs incurred in the acquisition and conveyance of such rights-of-way and it is understood that such acquisitions will be handled by the Commissioner under established policies and procedures and his decision in all instances shall be final. Standing - 41- AN ORDINANCE TO APPROPRIATE FUNDS OF $148,812 FOR THE REMOVAL OF SUBMERGED STEEL DEBRIS AND PILINGS AT FORNER SITE OF THE VIRGINIA BEACH STEEL FISHING PIER WHEREAS, there remain submerged steel debris and pilings at the former site of the Virginia Beach Steel Fishing Pier at 2nd Street on the Oceanfront which are a dangerous hazard to health; and, WHEREAS, it is the intent of the City Council to have the debris and pilings removed according to the desired specifications of the City Engineer and to elixninate any further physical hazard; and, WHEREAS, the removal can be satisfactorily performed at a cost of $148,812 as presented in the low bid of Smith Brothers, Inc. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, that funds of $148,812 be appropriated from the General Fund Balance to the Department of Public Works for the purpose of satisfactorily removing the submerged steel debris and pilings at the former site of the Virginia Beach Steel Fishing Pier; and, BE IT FURTHER ORDAINED that the City Manager is authorized to enter into a contract with Smith Brothers, Inc., the low bidder, to perform the necessary work.
